The agreement between you and Alpas Technology Pvt. Ltd. covering your use of Mize on the website, the Android app and the iOS app.

IMPORTANT: Please read these Terms and Conditions carefully before accessing or using Mize on any platform, including our website at mizeos.com, the Android application, or the iOS application. By registering an account, clicking "I Agree", or otherwise using our Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately stop using all Mize platforms.
1. Introduction
These Terms and Conditions ("Terms") form a legally binding agreement between you ("User", "Subscriber", "you") and Alpas Technology Pvt. Ltd. ("Mize", "we", "us", "our"), governing your access to and use of all Mize platforms including the website located at mizeos.com ("Website"), the Mize Android application, and the Mize iOS application (collectively, the "App"), and all associated features, tools, and services (collectively, the "Services").
These Terms apply uniformly across all platforms. Where a provision applies exclusively to one platform, it is expressly identified. All other provisions apply to the Website, Android App, and iOS App equally.
Alpas Technology Pvt. Ltd. is incorporated and registered in Nepal. We help civic leaders, entrepreneurs, and change-makers research, design, and launch technology that actually earns trust. In line with our vision, the Mize Restaurant Management System is primarily designed for businesses operating in the hotel, restaurant, and catering sector ("HoReCa") in Nepal, and for similar businesses internationally.
2. Definitions
The following definitions apply throughout these Terms:
- "Services" means all features, tools, functionalities, and content provided through the Website and the App, including but not limited to point of sale, billing, kitchen order management, table management, inventory tracking, staff management, customer management, vendor management, analytics, reporting, and all related modules.
- "Account" means the verified account created by a User to access the Services following successful KYC/KYB verification.
- "App" means the Mize mobile application available on the Google Play Store (Android) and the Apple App Store (iOS).
- "Website" means the Mize web platform accessible at mizeos.com and its subdomains.
- "Business Data" means all data, records, content, and information that a User inputs into, generates through, or uploads to the Services, including transaction records, menu configurations, inventory entries, customer information, financial reports, and staff data.
- "Subscription" means the paid plan selected by a User to access features beyond the Free Tier.
- "Free Tier" means the no-cost access plan subject to the usage limitations described in Section 5.
- "Full Access Trial" means the 30-day complimentary period during which all Subscription features are available at no charge, automatically applied upon KYC verification.
- "KYC/KYB" means the Know Your Customer or Know Your Business identity and business verification process required before Account activation.
- "Platform" refers collectively to the Website and the App.
3. Eligibility and Account Registration
3.1 Eligibility Requirements
To register for and use the Services, you must: (a) be at least 18 years of age; (b) operate or represent a lawfully constituted business entity; (c) have full legal capacity to enter into binding contracts; and (d) not be barred from using the Services under the laws of Nepal or any other applicable jurisdiction.
If you are registering on behalf of a business including a restaurant, hotel, catering company, bar, cafe, or any hospitality establishment, you represent and warrant that you are authorised to bind that entity to these Terms, and that the entity accepts these Terms.
3.2 KYC / KYB Verification
All Accounts are subject to mandatory KYC or KYB verification before activation. This requirement applies uniformly whether you register through the Website or the App. You agree to provide accurate, current, and complete information during verification, including:
- Valid government-issued photo identification of the account holder or authorised representative
- Business registration documentation or PAN/VAT certificate (for Nepal-registered businesses)
- Business name, legal form, and principal operating address
- Active phone number and email address for correspondence
Mize reserves the right to decline or revoke verification where documents cannot be authenticated, information is found to be false or outdated, or the business type does not qualify for the Services.
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials, and for all activity conducted under your Account, including activity by staff members you have authorised. You must notify us immediately at mizenepal@gmail.com upon becoming aware of any unauthorised access. Mize shall not be liable for losses arising from your failure to secure your credentials.
4. The Mize Services
4.1 Core Platform Modules
Mize provides a unified restaurant and hospitality management platform comprising the following modules, available across both the Website and the App, subject to your Subscription plan:
- Orders and Billing: point of sale with one-tap bill generation, VAT calculation, split billing, credit billing, and support for multiple payment modes, including cash, eSewa, Khalti, QR, and card
- KOT Management: digital kitchen order ticket routing to kitchen display screens or printers with item modifiers, priority flags, and station-specific queues
- Live Operations: real-time floor monitoring showing table status, running timers, active orders, and staff positions
- Table Management: floor plan configuration, table status tracking, cover counting, table merging, order transfer, and reservation management
- Others: other features are provided based on the subscription plan and the request from the businesses.
4.2 Platform Availability
Mize strives to maintain 99.99% uptime, but does not guarantee uninterrupted availability. Planned maintenance will be communicated in advance where possible. Unplanned outages will be communicated through in-app and website notices. The App offline mode allows core billing and KOT operations during internet outages; data will sync automatically upon reconnection.
4.3 Feature Modifications
Mize reserves the right to add, modify, or remove features from the Services with reasonable notice to active Subscribers. We will endeavour to provide 14 days notice before removing a feature that forms a material part of your Subscription.
5. Subscriptions, Pricing, and Payment
5.1 Full Access Trial
Upon completing KYC/KYB verification on any platform, every new Account receives a 30-day Full Access Trial with no charge and no credit card required. During this period, all features, including those otherwise restricted to paid Subscriptions, are fully available with no usage limits. The Full Access Trial is designed to allow you to experience the Mize platform before committing to a paid plan.
5.2 Free Tier
Accounts on the Free Tier are subject to the following limitations:
- Maximum of 100 billing transactions per calendar month
- Up to 3 table configurations
- Up to 25 menu items
- Up to 2 staff logins
- Billing and KOT functions available; Intelligence, full Reports, Expenses, Vendor Management, Customer Profiles, Offers, and Live Operations are restricted to paid Subscriptions
Mize reserves the right to modify Free Tier limitations with 30 days notice to affected users.
5.3 Paid Subscriptions
Paid Subscription plans unlock all platform features without usage caps. Current pricing for all available plans is published at mizeos.com. Subscriptions are available on a monthly and annual billing cycle. Annual plans are offered at a reduced effective monthly rate. All prices are displayed exclusive of taxes; applicable VAT at the prevailing Nepal rate will be added at checkout for Nepal-based subscribers.
5.4 Payment Methods
The following payment methods are accepted: eSewa, Khalti, bank transfer, debit card, and credit card. For international subscribers, card payment and available international gateway options apply. All transactions are processed by certified payment partners. Mize does not store complete card numbers.
5.5 Renewal and Cancellation
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your Account settings on any platform. Upon cancellation, you retain access to paid features until the end of the current billing period. Mize does not provide refunds for partial periods, except where required by applicable law.
5.6 Pricing Changes
Mize reserves the right to change Subscription pricing. You will receive a minimum of 30 days written notice of any price increase before it applies to your Subscription. Continued use after the effective date of a price change constitutes acceptance of the new pricing.
6. Acceptable Use
You may use the Services solely for lawful purposes in connection with the management and operation of your registered hospitality business. You must not:
- Use the Services to process transactions for illegal goods or services
- Attempt to reverse engineer, disassemble, decompile, or extract source code from any part of the App or Website
- Access the Services through any automated means not expressly authorised by Mize
- Share Account credentials with individuals who are not employees or authorised agents of your business
- Use the Services to store, transmit, or propagate malicious code, viruses, or disruptive data
- Attempt to gain unauthorised access to any system, account, or component of the Services
- Use the Services to record fraudulent transactions or manipulate financial data with the intent to deceive
- Sublicense, resell, or commercially exploit access to the Services without prior written consent from Mize
- Engage in any activity that places a disproportionate or unreasonable load on our infrastructure
Mize reserves the right to suspend or permanently terminate any Account found to be in breach of this Acceptable Use policy, without notice and without refund.
7. Intellectual Property
7.1 Your Business Data
You retain full and exclusive ownership of all Business Data you create, input, or upload through the Services. Mize does not assert any ownership claim over your transaction records, menu configurations, customer data, financial reports, or any other content you create. You grant Mize a limited, non-exclusive, royalty-free licence to store, process, and transmit your Business Data solely as necessary to provide the Services to you. This licence terminates upon Account deletion, subject to data retention obligations.
7.2 Mize Intellectual Property
All rights in the Mize platform, including the software, source code, algorithms, user interface design, visual elements, the Mize name, logo, trademarks, and all associated intellectual property are and remain the exclusive property of Alpas Technology Pvt. Ltd. These Terms do not transfer any ownership interest in Mize intellectual property to you. You may not use the Mize name, logo, or brand elements without prior written authorisation.
7.3 Feedback
If you submit suggestions, feedback, or ideas regarding the Services, you grant Mize an irrevocable, worldwide, royalty-free right to use, incorporate, and build upon that feedback without obligation or compensation to you.
7.4 Aggregated Data
Mize may use anonymised and aggregated usage data in a form that cannot identify any individual user or business for internal analytics, service improvement, and industry benchmarking. Such data does not constitute your Business Data and is not subject to the ownership provisions above.
8. Mobile Application: Android and iOS
8.1 App Store Compliance
Your download and use of the Mize App is subject to the terms of service of the applicable app store: the Google Play Store (Android) or the Apple App Store (iOS). In the event of any conflict between these Terms and the applicable app store terms, these Terms will prevail to the extent permitted by the app store operator.
Apple Inc. and Google LLC are not parties to these Terms and bear no responsibility or liability for the Mize App. All claims relating to the App must be directed to Mize, not to Apple or Google.
8.2 Device Requirements and Compatibility
You are responsible for ensuring your device satisfies the minimum technical requirements for the App. Mize does not guarantee that the App will function on all device models, hardware configurations, or operating system versions. We recommend keeping the operating system on your device updated to the latest version supported by your manufacturer.
8.3 App Updates
Mize may release updates to the App at any time. Certain updates may be mandatory for continued use of the Services. Failure to install mandatory updates may result in reduced functionality or loss of access. We recommend enabling automatic App updates through your app store settings.
8.4 Offline Mode
The App provides offline functionality for core billing, KOT, and order management operations when internet connectivity is unavailable. Data generated offline is queued locally and synchronised with Mize servers upon restoration of connectivity. Mize is not responsible for data loss, duplication, or discrepancies arising from extended offline use or from interruptions occurring during the synchronisation process.
8.5 Push Notifications
The App may request permission to send push notifications for order alerts, low-stock warnings, and operational updates. You may manage notification preferences through the system settings on your device. Disabling notifications may reduce the effectiveness of time-sensitive operational features.
9. Website: mizeos.com
9.1 Web Access
The Mize Website provides full access to all Services available to your Subscription tier through a standard web browser. No additional software installation is required beyond a current, supported browser with JavaScript enabled.
9.2 Cookies and Tracking
The Website uses cookies and similar technologies for session management, security, and performance analytics. Essential cookies are required for the platform to function and cannot be disabled. Non-essential analytics cookies may be managed through your browser settings. Full details are provided in the Mize Privacy Policy at mizeos.com/privacy.
9.3 Browser Compatibility
Mize supports current versions of Google Chrome, Mozilla Firefox, Safari, and Microsoft Edge. Mize does not guarantee full functionality on outdated or unsupported browser versions.
10. Third-Party Integrations and Services
The Services may integrate with or link to third-party services, including payment gateways (eSewa, Khalti), delivery platforms, and accounting tools. Your use of any third-party service is governed exclusively by the terms and privacy policy of that provider. Mize is not responsible for the availability, accuracy, security, or conduct of third-party services. We encourage you to review the terms and privacy policies of any third-party services you connect to Mize.
Mize may receive limited confirmation data from payment gateways to record transaction status. We do not receive or store complete payment card numbers, and all payment processing complies with applicable payment security standards.
11. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MIZE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
MIZE DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE; (B) ANY DATA GENERATED BY THE SERVICES IS ACCURATE OR SUITABLE FOR FORMAL ACCOUNTING, TAX, OR LEGAL PURPOSES; OR (C) DEFECTS WILL BE CORRECTED WITHIN ANY SPECIFIC TIMEFRAME.
The reports, analytics, and financial data generated by Mize are operational management tools only. They do not constitute accounting, tax, legal, or financial advice. You remain solely responsible for the accuracy of data you enter, for your VAT compliance and filings with the Inland Revenue Department of Nepal, and for all financial and tax obligations of your business. We recommend engaging a qualified accountant or tax professional for all formal financial reporting and compliance.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIZE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR LOSS OF GOODWILL.
THE TOTAL CUMULATIVE LIABILITY OF MIZE TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO MIZE IN THE THREE CALENDAR MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) NPR 5,000.
SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES. WHERE SUCH LAWS APPLY TO YOU, SOME OF THE EXCLUSIONS ABOVE MAY NOT APPLY IN FULL, AND YOUR LEGAL RIGHTS ARE NOT AFFECTED.
13. Indemnification
You agree to indemnify, defend, and hold harmless Mize and its officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) your use of the Services on any platform; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; (d) the content or accuracy of Business Data you submit; (e) any dispute between you and a third party in connection with your use of the Services; or (f) the use of the Services by your staff members under your Account.
14. Suspension and Termination
14.1 Termination by You
You may close your Account at any time by submitting a request through the Account settings on any platform or by contacting us at mizenepal@gmail.com. Upon termination, your access to paid features will remain active until the end of your current billing period. Your Business Data will remain available for export for 30 days following the termination date, after which it will be permanently deleted in accordance with our data retention schedule.
14.2 Termination or Suspension by Mize
Mize may suspend or permanently terminate your Account and access to the Services, with or without prior notice, in the event of: (a) material or repeated breach of these Terms; (b) non-payment of Subscription fees; (c) fraudulent, abusive, or illegal activity; (d) failure to complete or maintain valid KYC/KYB verification; (e) activity that Mize reasonably determines to be harmful to other users, third parties, or the integrity of the Services.
Where suspension is intended as a remedial measure, we will, where practicable, provide notice and a reasonable opportunity to rectify the breach before proceeding to termination.
14.3 Effect of Termination
Upon termination for any reason, your right to access all Mize platforms immediately ceases. The following provisions survive termination: Sections 7, 11, 12, 13, 15, 16, and 17.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Nepal, including the Electronic Transactions Act 2063 (2006), the Privacy Act 2075 (2018), the Consumer Protection Act 2075 (2018), and all other applicable Nepali legislation, without regard to conflict of law principles.
Any dispute, controversy, or claim arising out of or in connection with these Terms or the Services shall be resolved as follows: (a) the parties shall first attempt to resolve the matter through good-faith negotiation for a period of 30 days following written notice of the dispute; (b) if unresolved, the matter shall be submitted to the exclusive jurisdiction of the competent courts of Kathmandu, Nepal.
For users located outside Nepal, Mize will make reasonable efforts to comply with applicable local mandatory consumer protection laws to the extent required by the laws of your jurisdiction.
16. Changes to These Terms
Mize may revise these Terms at any time to reflect changes in our Services, business practices, or applicable law. Material changes will be communicated to you via: (a) a notice on the Website; (b) an in-app notification on the Android and iOS App; and (c) an email to your registered address. Notice will be provided at least 14 days before the amended Terms take effect.
Your continued use of any Mize platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must cease using all Mize platforms before the effective date.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Mize Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Mize regarding the Services and supersede all prior agreements, understandings, and representations relating to the same subject matter.
17.2 Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.
17.3 No Waiver
Failure by Mize to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision in any future instance.
17.4 Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms to any third party without prior written consent from Mize. Mize may freely assign its rights and obligations in connection with a corporate restructuring, merger, acquisition, or sale of assets, provided that the assignee assumes the obligations of Mize under these Terms.
17.5 Force Majeure
Mize shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, power failures, internet infrastructure disruptions, labour disputes, or pandemic-related restrictions.
17.6 Language
These Terms are written in English. In the event of any inconsistency between the English version and any translated version, the English version shall prevail.
